We know there are two sides to every story. Unfortunately, when a spouse or partner calls the police because of a heated argument or physical confrontation, the police will generally talk to the party who made the call, and accept his or her version of the story. More often than not, the woman makes the call. Even if she makes it clear to the police that she does not want her spouse or partner arrested, someone is going to jail nearly 100 percent of the time, often without even being given the opportunity to tell his or her side of the story. It doesn't mean you did anything wrong. It certainly doesn't mean you are guilty of a crime of domestic violence.

Once The Case Is Filed, All Bets Are Off

When the police investigate a domestic violence allegation, they write their findings in police reports. Those reports go to the prosecuting attorney. If the prosecutor feels there is sufficient evidence, and files formal charges in court, those charges are very unlikely to be dismissed until they are resolved at trial. Even if the complaining spouse or partner contacts the prosecutor and asks that the charges be dismissed, it will not happen.

Don't count on your spouse or partner's ability to persuade the prosecutor to dismiss the case. It is the prosecutor's decision whether or not to proceed, and they always do. You need skilled, experienced representation to avoid a domestic violence conviction that could affect:

  • Your ability to obtain custody or visitation of your children
  • Your current employment and your future ability to get a different job, a promotion or security clearance
  • Your right to purchase or possess a firearm
