Understanding Nebraska DUI Charges
As in most states, Nebraska has two elements of a DUI charge:
- The criminal charge filed through the court system
- The Automatic License Revocation process conducted by the Department of Motor Vehicles.
The criminal charge you receive will depend on your blood alcohol content (BAC), as well as whether this is your first, second, third or higher DUI charge. For example, an aggravated DUI (a blood alcohol level higher than .15) is a more serious matter than a DUI (BAC of .08 — .15).
The Automatic License Revocation process could involve the suspension of your driving privileges for a minimum of 90 days up to one year. You only have 10 days from the date of your arrest to fight this revocation.
