Nebraska Appeals and Post-Conviction Relief

While you may have been convicted of a crime, you still have the right to have that conviction and sentence reviewed by a higher authority, and you have the right to have an attorney help you prosecute your appeal. Trials of criminal matters can be complex and difficult to understand. We rely on judges, lawyers and jurors to conduct criminal trials in a manner that will result in a fair and just verdict that is based solely and only on the evidence presented. The fact that we must rely on people to insure this level playing field, however, means that mistakes will inevitably be made. When a mistake is made, you need a skilled, aggressive attorney to address that error and obtain favorable relief from the appellate court.

Error occurs in criminal trials on a frequent basis. Judges, for example, are routinely called on to make rulings on the admissibility of certain evidence. Sometimes prosecutors are allowed to put on evidence that is simply inadmissible which may have had a devastating effect on the jury and directly resulted in your conviction. Conversely, you may have had very important evidence of your own that the court did not allow you to adduce for the jury's consideration.

Error can often directly impact the jury's verdict and the sentence imposed by the court. Through the appellate process, we work diligently to demonstrate that error occurred in the trial court, and that any conviction based, in whole or in part, on that error, must be thrown out. In many cases, we may be able to have your conviction and sentence vacated and have the case sent back to the trial court. Under other circumstances, we can argue that the appellate court should reduce a sentence erroneously imposed by the trial court.
